These terms govern your use of PropertyFX, operated by Monadnock Cyber, LLC.

What PropertyFX is

PropertyFX compiles public-record information about real property, attributed to its publishers. It does not provide valuations, appraisals, title insurance, legal advice, or real estate brokerage services.

Not a consumer report

PropertyFX reports describe property, not people. PropertyFX is not a consumer reporting agency, and its reports are not consumer reports. They may not be used as a factor in any decision about an individual's eligibility for credit, insurance, employment or housing, or for any other purpose covered by the Fair Credit Reporting Act.

Permitted purposes

You may request a report or run a Pro search or export only for one of these purposes, which you certify when you do:

• Due diligence on acquiring or developing this property
• Legal, title or closing work concerning this property
• Review of this property as loan collateral
• Assessment of physical or environmental risk to this property
• Research on property held in or considered for a portfolio
• Sourcing property for investment, or lawful business outreach about this property
• General research on this property

Prohibited uses

• Any use as a factor in establishing an individual's eligibility for credit, insurance, employment, housing or tenancy.
• Any use that would cause a report to be a consumer report under the Fair Credit Reporting Act.
• Harassing, threatening or stalking anyone, or locating a person who has asked not to be found, including by tracking a property to follow the people connected with it.
• Discriminating against anyone, or contacting anyone in violation of the law.
• Reselling or redistributing reports except within your own organization for the certified purpose.
• Scraping, crawling, or bulk or automated collection of PropertyFX, or getting around any limit or access control.

Outreach

You may use PropertyFX to research properties and to make lawful business outreach about them. You are solely responsible for that outreach, including compliance with telemarketing, do-not-call, email, fair housing, licensing and privacy laws, and for honoring any request to stop.

Accounts and enforcement

One full report is available without an account. The rest take a free account. These terms apply either way. We log every report request and may investigate suspected misuse and suspend or terminate accounts that break these terms.

Accuracy

Records come from public sources that can be incomplete or out of date. Verify every record at its source. Parcel lines are not survey boundaries; flood information is not an official flood zone determination. Environmental records are a screen, not a Phase I environmental site assessment. Utility hosting capacity is the utility's published figure, not an interconnection approval. Market signals are flags drawn from public records. They are not estimates of value or advice to buy or sell, and a recorded price may reflect a non-market transfer.

No warranty

PropertyFX is provided as is and as available, without warranties of any kind, express or implied, including accuracy, completeness, merchantability and fitness for a particular purpose.

Limitation of liability

To the fullest extent the law allows, Monadnock Cyber, LLC is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or lost deals, arising from your use of PropertyFX. Our total liability for any claim will not exceed the greater of the amount you paid us in the prior twelve months or $100.

Your responsibility

You will defend and indemnify Monadnock Cyber, LLC against claims arising from your use of PropertyFX, including your outreach and any breach of these terms.

Changes and governing law

We may change these terms by posting a new version here; continuing to use PropertyFX means you accept it. New Hampshire law governs these terms, and disputes belong in the state or federal courts in New Hampshire.
